Scott N. Silver was employed by the New Jersey Casino Control Commission in various legal capacities from its inception in 1977 until 1986. As Supervising Project Attorney, he was responsible for legal matters involving the licensing and regulation of alcoholic beverages in casino hotel facilities during the start-up years of the New Jersey casino industry. The Casino Control Act granted the Commission sole jurisdiction for alcoholic beverage licensing and regulation in casino hotel facilities.
From 1986 through 1988 Mr. Silver served as First Assistant Solicitor for Atlantic City and counsel to its Municipal Board of Alcoholic Beverage Control. At that time, Atlantic City had approximately 150 non-casino retail alcoholic beverage licensees.
Since 1988, Mr. Silver has been in private practice in southern New Jersey. He left the New Jersey office of Dilworth Paxson as a partner in 1991, and practiced through Scott N Silver, P.C. in Linwood (Atlantic County) until 2023. He now practices “of Counsel” to Nehmad Davis & Goldstein in Egg Harbor Township. The vast majority of his practice is devoted to alcoholic beverage (and casino hotel alcoholic beverage) licensing, regulatory and disciplinary matters; the buying and selling of licensed businesses; and the structuring of operational arrangements (e.g. management and concession agreements) to comply with alcoholic beverage law.
Mr. Silver was admitted to the practice of law in New Jersey and Pennsylvania in 1978 and has practiced continuously since that time.
Since 2005, Mr. Silver has served as a member of the New Jersey State ABC Director’s Advisory Committee. The Advisory Committee of approximately thirty-five individuals comprises a cross-section of the alcoholic beverage industry (e.g. manufacturers, wholesalers, retail distribution licensees, consumption licensees, and trade organizations such as the NJ Licensed Beverage Association and the NJ Restaurant Association). The committee meets approximately four times per year in Trenton with the Director of the NJ Division of Alcoholic Beverage Control and his senior legal staff to discuss industry issues and trends, pending legislation, ABC regulatory developments and changes, and suggested regulatory amendments. It serves as a vehicle for the dissemination of new ABC policies and directives, and for the exchange of ideas and concerns between the industry and the regulatory agency.
Mr. Silver is a associate member of the New Jersey Licensed Beverage Association and has been a speaker about ABC regulatory issues at the annual NJLBA convention, the NJ League of Municipalities convention and at meetings of various Municipal Clerks Associations.
Mr. Silver has served as speaker and panelist for the NJ State Bar Association’s Institute of Continuing Legal Education course, “The ABC’s of Retail Liquor License Practice”. Most recently, he also served as speaker, panelist and moderator for the course.
